Summary
Timothy McMahon has been an attorney with Wiedner
& McAuliffe for more than 20 years. In his career he has tried
more than 50 cases to verdict. His civil litigation and trial practice
emphasizes product liability, personal injury, trucking and construction
accident defense, premises liability, and insurance coverage matters.
Tim has several signficiant construction accident, product liability
and trucking accident verdicts among his reported cases and acts
as regional tort litigation counsel for Coca-Cola Enterprises Inc.
in northern Illinois and Indiana. He also frequently advises clients
on employment and commercial matters, as well as other state and
federal trial and appellate issues.
Tim joined the firm after five years of service
as an Assistant State’s Attorney in Cook County, Illinois.
He has addressed numerous professional audiences and groups on tort
and insurance coverage matters. Tim is also involved in a wide range
of community service activities.

Among the significant defense litigation that
Tim has handled are the following cases, in which the lower
court was affirmed by the Illinois Court of Appeals:
- Lowell v. Oswego Excavating Company:
plaintiff's attempt in this catastrophic trucking accident lawsuit to impose liability upon client excavating company was rejected by the trial court and the Appellate Court.
- Rummel v. Yazoo Manufacturing:
this product liability lawsuit alleging improper lawmower
design incorporated a third party suit against a high school,
which was rejected under the statute of limitations of the
Illinois Local Government Tort Immunity Act.
- Calderon v. Echo Products: a product
liability plaintiff sued the manufacturer of a lawn trimmer
for eye injuries, but was held largely responsible because
he disregarded instructions to wear safety goggles.

Professional Background
From 1977 to 1983, Tim served as an Assistant State’s Attorney
for Cook County, Illinois. He handled a variety of litigation, working
in the Appellate Division, the General Felony Trial Division and
the Gang Crimes Prosecution Unit of the Trial Division.
Publications and Presentations
While Assistant State’s Attorney, Tim was an Instructor in
Trial Practice. More recently he has presented numerous seminars
to various insurers relating to tort and insurance coverage matters.
