Construction Disputes

Wiedner & McAuliffe represents construction companies, contractors, architects and engineers in disputes arising at every stage of the construction process—from commitments at the project’s inception to fundamental disputes over professional performance and related recovery of insurance costs.

We proactively work to avoid or resolve issues that can lead to litigation, but have substantial experience in the mediation, arbitration and litigation of disputes involving:

  • Warranty claims
  • Project scope disputes
  • Materials failure
  • Allowable cost disputes
  • Design error or deficiency
  • Contract disputes
  • Defective installation
  • Delay claims
  • Job site injury
  • Mechanic’s liens
  • Performance bond claims
  • Maintenance and repair obligation

These encompass areas of litigation that are at the heart of our defense practice and at which our attorneys are especially skilled.

  • Insurance cost recovery. We counsel some of the country’s largest insurance carriers, and apply our knowledge of subrogation and damage recovery to such issues as architect and engineer professional liability coverage and payment and performance bonds covering design and product defect claims.
  • Prevention of spoliation. In claims of error or inefficiency during construction, we work with our clients to preserve and analyze all project documents and correspondence, including change orders, to identify the responsibility for problems.
  • Product liability. Our experience with product liability defense positions us to handle lawsuits involving claims of materials failure, design error, defective installation and substandard quality, as well as damages resulting from fire or explosion due to alleged product defects.
  • Professional liability. We successfully defend architects, engineers and other design professionals against a wide range of tort claims alleging financial or physical loss due to negligence, errors or omissions, particularly those involving alleged design error, cost overruns and project delays.
  • Workers’ compensation and job site injury. We use our extensive workers’ compensation experience to defend claims of construction job site injury and wrongful death. Our attorneys can handle the full range of issues involved, including defense of claims for lost wages and medical treatment, litigation involving third-party claims, general tort claims, and claims involving occupational diseases, fraud and insurance recovery.

Construction disputes involve high stakes: multi-million dollar investments, professional reputations, even business survival. Wiedner & McAuliffe attorneys aggressively defend the interests of contractors and design professionals in these matters, using the full range of our commercial litigation and insurance cost recovery skills to protect our clients’ interests.
